Terms And Conditions

1. Services & Scope
1.1 Cobs Tech Solutions provides IT services including
hosting, email setup, website deployment, and technical
support as outlined in your accepted quote.
1.2 Each quote specifies exactly what’s included. Anything
not listed is considered out-of-scope and will be quoted
separately.
1.3 We operate on a Core Stack: Google Workspace, cPanel, Python, Java and
WordPress. We support these tools to give you fast, expert
service.
2. Software & Licenses
2.1 Standard tools: If your project uses our Core Stack, all
software costs are included in your monthly fee unless stated
otherwise.
2.2 Non-standard tools: If you require software outside our
Core Stack (e.g. Visual Studio Pro, specific CRMs, custom
plugins), you have 2 options:
a) Client provides licenses: You supply valid
licenses/access and we charge for setup + labor only.
b) We procure licenses: We will purchase and manage
licenses for you at cost + 20% admin fee, invoiced upfront
before work begins.
2.3 We do not purchase software on speculation. All non
standard license fees must be paid before installation.
2.4 Free trials may be used for demonstrations only, not for
live production systems.
3. Payment Terms
3.1 Projects: 50% deposit required to start work, 50% on
completion before handover.
3.2 Monthly services: Billed in advance on the 1st of each
month. Service may be suspended if payment is 7 days
overdue.
3.3 Late payments: Subject to 2% interest per month as per
the National Credit Act.
3.4 Quotes are valid for 14 days.
4. Client Responsibilities
4.1 You must provide timely access, content, and feedback.
Delays longer than 5 business days may incur rescheduling
fees.
4.2 You are responsible for keeping your own login details
secure and for maintaining valid licenses if you chose option
2.2(a).
4.3 You warrant that you own or have rights to all content you
give us to upload/host.
5. Uptime & Support
5.1 For managed hosting/email plans, we target 99.5%
uptime. Scheduled maintenance is excluded.
5.2 Support hours: Mon–Fri, 8am–4pm SAST. After-hours
support billed at R450/hr.
5.3 We are not liable for downtime caused by third parties:
Eskom, Microsoft, Google, your ISP, or lapsed licenses not
managed by us.
6. Warranties & Liability
6.1 We provide services with professional skill and care. We
do not guarantee that software will be error-free or that you’ll
get more customers.
6.2 Our total liability for any claim is limited to the fees you
paid us in the last 3 months. We are not liable for indirect
losses like loss of profit.
7. Cancellation
7.1 Monthly plans: Cancel anytime with 30 days written
notice. No refunds for part months.
7.2 Projects: If you cancel after work starts, deposit is non
refundable and work completed will be billed.
7.3 We may terminate service with 7 days notice if invoices
are unpaid or T&Cs are breached.
8. Intellectual Property
8.1 You own your content and data.
8.2 We own our processes, code libraries, and
documentation. Custom code we write for you is yours once
final payment clears.
9. Referrals & Reviews
9.1 If you’re happy with our work, we may ask for a Google
review or permission to use your logo as a client. You can
say no.
9.2 We’ll never share confidential info.
10. Governing Law
10.1 These terms are governed by the laws of South Africa.
Disputes will be handled in Johannesburg courts.
